Two Questions Allowed by the ADA
The Americans with Disabilities Act (ADA) allows only two questions to be asked when someone is accompanied by an animal (unless the disability is obvious, in which case no questions can be asked). If the animal meets the necessary criteria, it should be allowed to accompany the individual in all public areas. The two questions are:
Is the animal required because of a disability?
What task or work has the dog or miniature horse been trained to perform?
When Can an Animal Be Denied Access?
While the ADA allows individuals without an apparent disability to be asked the above questions, there are certain situations in which an animal may be denied access to an ADA-covered facility:
The animal is out of control and its handler does not take effective action to control it.
The animal is not housebroken.
The animal poses a direct threat to the health or safety of others that cannot be eliminated or reduced through reasonable modifications to policies or practices.
